At Innova Health Tech Inc. and its subsidiaries (“Innova Health”, “we”, or “us”), we care about your privacy and are committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect when you visit our websites, mobile sites, social media pages that we control, and HTML formatted email messages (collectively, the “Sites”), and our practices for collecting, using, protecting, and sharing that information.

By accessing or using our Sites, you agree to this privacy policy. This policy may change from time to time. Your continued use of the Sites after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Information We Collect

When you use our Sites, we may collect your Personal Information when you provide it to us, when it comes linked from other sources, or through automated methods. Personal Information is:

  1. Information that identifies you as an individual, such as: Your name, postal address, email address, phone number, profile picture, social media account and others.

  2. Unique identifiers, such as your username, password, marketing preferences, browser type, IP address, the equipment you use to access our Sites and your usage and navigation details.

  3. Information about you from third party sources such as companies, organizations, affiliates, advertising networks, public databases and others.

Manual Submission

Personal Information can be submitted to us directly when you communicate with us offline (in person or by telephone), via email or via the Site (by entering data or uploading files) or when you authorize Innova Health to access, retrieve and/or import Personal Information from another user or third party on your behalf. Additionally, if you become a customer of Innova Health, you will be required to register by submitting Personal Information via the Services, email or offline. This could include name, email address, mailing address, telephone number(s) and other contact and billing information.

Automatic Submission

Whenever your computer, mobile device or tablet visits, logs in or otherwise interacts with the Site, we gather data from your device and the operating software of your device transmits a ‘request’ to us. That request includes non-personal information that is necessary to identify and route the information your device is requesting. This communication is necessary for all website and Internet services.

We also use cookies (sometimes referred to as “web beacons” or “server logs”). Cookies are files that web browsers place on a computer’s hard drive that tell us whether customers or visitors have been to the Site previously, and they often include an anonymous unique identifier.   • Date and time a ‘request’ is transmitted through the Site

Purpose of Personal Information

Innova Health is a cloud-based “Electronic Health Records” Software-as-a-Service (SaaS) platform designed to help long-term, post-acute care rehabilitation providers capture and manage clinical and financial information related to patient and resident care. Additionally, it may also be used to connect Innova Health customers with other variety of related service providers and healthcare networks. We primarily collect Personal Information as necessary to communicate with you and/or to provide the Services. Some Personal Information (but not PHI) also may be collected for marketing and sales purposes (e.g., if you request a “demo,” “have questions,” “request to participate in a webinar,” etc. and complete a related form on the site). Your information may also be used when you register for a webinar or download content, or if you visit a part of our Site where we deploy cookies from LinkedIn, Facebook, Twitter, etc. (in which case, their privacy policies will apply).

Personal Information and non-personal information may be used for the following reasons:

  • To register customer accounts

  • To contact customers to discuss their experience with the Services, current and future needs as a customer, or to communicate future

  • promotions or special events which might benefit them

  • To contact a prospective customer

  • To provide our cloud-hosted SaaS Services

  • To operate, maintain, manage and administer the Services, including processing registrations and payments, and diagnosing technical problems

  • To respond to questions and communications

  • To make service or administrative announcements to customers about unscheduled downtime or new features, services, products, functionality, terms, or other aspects of the Services

  • To perform audits, research, measurements and analyses to maintain, administer, support, enhance and protect the Services, including determining usage trends and patterns and measuring the effectiveness of content, advertising, features or services

  • Saving user preferences

  • Preserving session settings and activities

  • Providing limited auto-fill functionality for those who use the Services frequently

  • Analyzing various features and content of the Services

  • To create new features, products or services

  • To contribute to certain health and medical research (only non-personal information will be used)*

  • To provide benchmarking and performance tracking solutions*

* We may track and analyze non-identifying, aggregate usage, and volume statistical information from our visitors and customers and may provide such information to third parties. We are committed to ensuring privacy and protecting Personal Information. However, we are also committed to collecting and/or providing data, valuable insights and analytics that may serve to enhance performance and quality.

We may use various technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Some web browsers include a “Do Not Track” feature. Our Sites may comply with web browser “Do Not Track” signals. You can edit your browser preferences to refuse all or some browser cookies, or to alert you when cookies are being sent (select the “Help” menu on your browser to learn how to change your cookie preferences). You may also clear your cookies in your browser settings if you would like to delete cookies that we placed on your hard drive. Third-Party Use of Cookies Some content or applications, including advertisements, on the Sites are served by third parties includingadvertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies, to collect information about you when you use our Sites. They may collect information about your online activities over time and across our Sites and/or different sites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

Additionally, we use Google Analytics to track and analyze page usage behavior to improve performance in the use of the Services and the Site. Support, Education Services and Purchase orders

Personal Information collected through the Site may be accessed and used by Innova Health to respond to customer requests for support, to provide education or consulting services and/or to confirm customer compliance with the terms of its purchase (as set forth in signed orders). This may include testing and applying new product or system versions, patches, updates and upgrades; monitoring and testing system usage and performance; and, resolving bugs and other issues which a customer reports to Innova Health.

Personal Information collected for these purposes is only used for time periods relevant to fulfill such purposes.

How We Share Your Personal Information

We may only disclose Personal Information as follows:

  • To our subsidiaries and affiliates

  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Innova Health Tech assets

  • For any other purpose disclosed by us when you provide the information.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request

  • If we believe in good faith that disclosure is necessary or appropriate to protect the rights, property, or safety of Innova Health, our customers or others

  • We may disclose aggregated information about our users, and information that does not identify any individual, without restriction

Your Options

We strive to provide you with choices regarding the collection of your Personal Information and its use by us. We will retain your Personal Information for as long as it is reasonably useful for commercial purposes. At any time, if you disagree with our use of your Personal Information, you may contact us at privacy@innovahealth

to correct, update or request deletion of your Personal Information. We will try to comply with your request as soon as reasonably practicable, but please note that we may need to retain certain information for recordkeeping purposes and there may be residual information that will not be removed or changed.

Notwithstanding the foregoing, we will retain your Personal Information if necessary to comply with the law, resolve disputes or comply with or enforce our agreements.

If you do not wish to have your contact information used by us to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request at privacy@innovahealth. If we have sent you a promotional or marketing email, you may opt out by following the unsubscribe instructions included in the email.

Visitors From the European Economic Area

Our Sites are intended only for United States users. However, visitors of our Sites who live in the European Economic Area may have some additional rights with respect to the processing of their Personal Information.

The European Union’s General Data Protection Regulation and other applicable data protection laws provide certain rights for data subjects. You are entitled to request details of the personal data we hold about you and how we process it. You may also have the right in accordance with applicable data protection law to:

  • Have it rectified or deleted,

  • Restrict our processing of that personal data,

  • Stop unauthorized transfers of your personal data to a third party; and in some circumstances,

  • To have personal data relating to you transferred to another organization

Children Under the Age of 13

Our Sites are not intended for children under 13 years of age. No one under age 13 may provide any Personal Information on the Sites. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on our Sites. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. How We Protect Your Personal Information

We have implemented security measures designed to protect your Personal Information collected on our Sites from accidental loss and from unauthorized access, use, alteration, and disclosure. We make reasonable efforts to protect your Personal Information stored on our Site’s servers by using computer security products (such as firewalls) and by establishing industry standard safeguards.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Sites.
